Terms and Conditions

Cancellation and Returns

Special order and manufactured goods are non-cancellable and non-returnable.  Stock items are returnable if they are in the original packaging and in new condition.  Used items will not be accepted for return.  After 15 days, a 15% restocking fee applies for stock items. After 30 days, deposits are not refundable.

Warranties

The warranty coverage for each item is the warranty coverage that the manufacturer of that item offers.  Forshaw does not offer any implied or explicit warranty above the manufactured warranty.  To file a warranty claim, call 314-993-5570 or email info@forshaws.com.  Warranty claims require photos and a description of the problem or defective part.  After we receive a confirmation from the vendor, we will advise if the warranty repair or replacement will be done with parts we stock or if we need to order parts, as well as lead time for completion of the claim.

Notice to homeowners for installed products

Title and ownership to materials that we install pass upon your complete and permanent installation.  Because installed goods “become a fixture” in your home, please note the following:

For the state of Missouri:

Failure of this contractor to pay those person supplying material or services to complete this contract can result in the filing of a mechanic’s lien on the property which is the subject of this contract pusuant to chapter 429 RSMo.  To avoid this result you may ask this contractor for “Lien Waivers” from all person supplying materials or services for the work described in this contract.  Failure to secure lien waivers may result in your paying for labor and material twice.

For an Illinois-owner occupied residence:

The subcontractor providing this notice has performed work for or delivered material to your home improvement contractor.  These services or materials are being used in the improvements to your residence and entitle the subcontractor to file a lien against your residence if the labor, services, material, fixture, apparatus, or machinery, forms or form work are not paid for by your home improvement contractor.  A lien waiver will be provided to your contractor when the subcontractor is paid, and you are urged to request this waiver from your contractor when paying for your home improvements.

For Illinois-new residential construction:

The subcontractor providing this notice has performed work for or delivered material to your home improvement contractor.  These services or materials are being used in the improvements to your residence and entitle the subcontractor to file a lien against your residence if the services or materials are not paid for by your home improvement contractor.  A lien waiver will be provided to your contractor when the subcontractor is paid, and you are urged to request this waiver from your contractor when paying for your home improvements.

Collections and past-due accounts

If an account is delinquent with respect to payment, we will add our collection fees to the due balance.  If we must pursue legal action to collect a past-due balance, we reserve the right to recover all attorney’s fees associated with that collection.
